On-Demand - The Role of Domestic Violence in Alternative Dispute Resolution

Settling a family law case out of court can be difficult when there is domestic violence between the parties. The dynamics of domestic violence can conflict with the purpose of mediation. Rana Alexander and Laurel Mohan, a qualified rule 114 neutral, discuss how domestic violence affects alternative dispute resolution processes and the attorney’s role in the proceedings. They also cover how casehandlers can educate judges on why alternative dispute resolution is not beneficial to the parties in cases where there has been domestic violence.
